Dear Senior,
Greetings for the day
Recently i joined in a construction based firm from hyderabad.
it is incorporated and functioning since 13 years.but the strange thing is that, there is no statutory things implemented here (ie PF ,ESI )
it means what ever the salary negotiates with new joinees that would be their takehome for all levels without any deductions.
if i want to implement all the above mentioned stuff as a hr person , will it be possible now or will it leads to any statutory complications.
kindly suggest.

He relieved from X company on March 12 2013 and Joined in Y company on the same day. When he is going to join in saome Z comapny will that create an issue?

Dear Rakesh
Greetings of the day
Your said company has to come under BOCW ACT 1996.
They have to take registration under this Act before statrt up of any job. For their Offices , they have to take registration under Shops and Establishment Act.
Other compliances are
1. Registration under EPFO
2. Registration Under ESIC
3. Registration and Enrollment under Orofessional Tax Act
4.Income Tax
5. Employees Compensation Act if ESIC i not applicable for people.
6.Registration under Contract Labour (R&A) ACT 1972.
etc.
There are several Local Act , State Acts to be maintained.

Dear Friend,
There are lot of problems while inspection, better way is close the company or start new company/firm with other PAN card and to be registered with Shop Act, EPFO, ESIC, PT, LWF and take other Local Registrations/Licenses, will not arise any type of problems. Best Luck.

To start up a business, someone has to bell the cat. Tell the higher management, if they want to work with Multinationals and other companies, they should ask for Statutory Compliance.
Registration under CLRA ACT (R&A) ACT 1970 is must.
Maintaining of Registers under the Act is required.
Trade License, Service Tax registration. PAN number necessary.
PF registration, Employees Compensation Act 1923 needs to be followed.
Before giving you the contract, Principal Employer will ask you theses before PQ (Pre-qualification of a Vendor) or before register you as a Vendor under him.

Hi Rakesh,
You just tell them (management) regarding further consequences while Inspection if you will approach with Authority for Registration under PF/ESIC/PT/LWF etc. on the basis of current business.
Secondly, I am providing a Payroll Outsourcing Service, a agreement made between me & client, submit the all registration documents, compliance of my company with Principal Employer, means you are deputing as sub-contractor, your all employees will on my company's payroll, I shall comply everything, no problems will arise. But you should take permission form your clients for sub-contractor for compliance point of view.
