Hi, I need to clarify my doubt regarding the prohibition period at Pvt jobs. I'm working in one company. I have 2 years of experience before that. Before joining I haven't check the offer letter clearly. It is mentioned the prohibition period. Is it right to give 12 months prohibition period for 2 years experienced candidate?
In the offer letter, it is mentioned as 12 months prohibition period. In the first 3 months we usually have monthly one leave. But suddenly manager saying in the prohibition period you are not eligible for paid leaves. What is Indian law for employees leaves in the prohibition period. If a manager intentionally doing this for how I can approach legally. Please suggest me.

First of all, what is this prohibition period, your casual and cavalier attitude is evident from this. Now, you don't look seriously at the offer of appointment and try to understand its implications and is seeking a ready made legal bail out solution to get you out of the situation. This casts very serious doubts on you being worthy of our efforts.
Yet, you have unconditionally accepted the offer of appointment and is hence bound by it. Probation period of one year is widely accepted for technical and administrative posts. But it looks outrageous that an employee cannot get any paid leave during the period of probation. It is not clear as to whether you are working in a factory or a commercial establishment to guide you regarding leave entitlement. You can consult the applicable Standing Orders in case you are a factory or the State Shop & Establishment Act as the case may be .
