Dear Shraddha Kerkar,

This is a little strange case wherein an employee does not want to be confirmed. Otherwise, employees vie to get a confirmed status. They become anxious if they are not given a letter of confirmation of employment.

Why employee is refusing to accept the confirmation letter? Did you or anyone else speak with him/her? What is his/her take on declining it? Does he/she want to quit the company? Is there a difference between the notice period for a probationer and a confirmed employee? Is he/she thinking that by not accepting the confirmation letter, he can continue as a probationer and thereby keep the exit door ajar?

Confirmation letter or otherwise, under the provisions of the standing orders, it is incumbent on the employees to accept the official communication. Refusal to accept the official communication is misconduct. Therefore, the administration of your company reserves the right to initiate disciplinary action for the act of misconduct.

Thanks,

Dinesh Divekar
