Sir,

Suddenly I Fell Ill & Was Hospitalized For Approx. 15 Days, ( Medical Treatment & Prescription Available ) Doctors Declare That I Am In Dippression & Need Approx. 45 -60 Days Bed Rest.
While I Was In ICU , A Admin Executive From My Office Also Visited Continousely For 3 Days Management Including My Boss Was Aware About The Same. After 45 Days I Recd. Letter Containing That Immediately Come To Office & Explain The Reason Of Your Absent. In Reply I Explained All The Matter With Medical Prescription & Discharge Slip Copy & Also Requested Them To Terminate Me From Job As Still Medically I Am Unfit Or Dont Know What Time Will Take To Be Fully Fit Else Pls. Sanction My Pending Leave Which Are Approx 60 Days. But I Did Not
Recd. Leave Encashment & Also Not Terminated Me As Well Not Sent Any Response To Me,

Approx. 3 Months Ago Again I Sent My Resignation On Ground Medically Unfit With Current Medical Treatment But Still They Have Not Accepted My Resignation & Showing Me Absent.
Presently I Psycatric Patient & Its Total 10 Months Has Gone.

Now My Question Is - Are There Any Timeline To Accept The Resignation Or Depends On Employers Wish ?
There Is Some Improvement In My Health But Decided Not To Re-Join Such A Orgnaization.
Can I Join Another Job As Its More The 80 Days Has Gone Of Submit The Resignaion ?

Pls Give Your Kind Suggestion.

Hope you get better soon and return to normal routine soon enough.
My question to you is, what is your exact question? Do you want to move away from the company for good? or You have now got a job and need a termination or releving letter from them so that you can join the new organisation?
I am asking these questions as the company has done legally everything to prove that you are absent as you are on a prolonged medical leave. You have said that they mark you absent, means you have spoken with the company HR or representative and he has communicated to you something (which you have not shared) or a reason has been given to you to not accept the resignation or termination. So if the company is ready to take you back as they feel that you are a good employee, as very few companies wait for more than 10 months for a employee to join back.
So what is the exact query?

In reply - First of all i want to move to another company as when i was hospitalized, the company did not even released my
salary. Secondly i when i was in hospital i have Borrowed money for medicine & hospital bill from my relative/friends which will be approx. 1.5 Lac. Now i have only option to tender the resign & get the full & final which is approx. Rs. 6 Lacs. & give back the borrowed money of relative. Moreover company neither helped me financial even approx. 60 days balance leave was there & in this situation they adjust my leave can pay the salary whatever it was.

Now I dont wants to re-join the company thats why i tender my resignation two times & sent thru speed Post. Acknowledgement of Speed Post /resignation are available with me. Now Its more 90 days has gone to receipt of
resignation but stil the company is showing me absent.

Now the main question is - can i join another job even the 90 days has gone or is there any time line to accept the
resignation. In case i join another comopany. can the previous employer raise any issue or is an offence to join the another job without accepting the resign by previous company.

Pls. Pls. Sir, guide me...........

Dear Ravinder,
You will need to personally go to the office, speak with the management, handover your resignation, discuss about the exit and present them with the medical certificates. They may want you to come for a few days or weeks, so that if there are any previous queires, they can solve them.
Speak politiely with them and suerly there will be way out from the same. Instead of telephone or emails, make a personal contact with them and have the issue sorted out. Just remember, no negatives in mind and words.

legally what are timeline to accept the resignation in private sector
or depend on their wish.

Dear Ravinder,
There is no prescribed time limit for the same. It is generally from the date of putting your resignation to the concerned authority. In your case, surely there is a huge gap. Therefore, you personally meet them with the hard copy of the mails and other relevent documents. Sit across the table, communicate and then take a step further.
