Dear HR Professionals: This is Ajay. Pursuing MSW HR. Im excited to know about the affiliated trade unions. Industries can deny the registration of affiliated Trade unions. For instance: Samsung thozilalar sangam a trade union affiliated with CITU. But the Samsung management didn't accept their request. Is there any provisions to deny the registration? Why Not?

Registration of trade union is not within the control of any employer. It is given by the Registrar appointed under the relevant sections of Trade Union Act. As such if there are ten percent of workers subject to a minimum 7 persons, and all these members are of persons of sound mind capable of entering into a valid contract there is no chances of refusing registration. The employer cannot interfere in it. But the employer can refuse to recognise a trade union. Tamil Nadu has not enacted separate Act to recognise trade unions like Maharashtra, MP or Kerala have done. Therefore, as such there is no law to govern recognition of trade unions in Tamil Nadu. But we should not ignore the fact that we are also bound to obey the guidelines of ILO which are accepted norms. As per ILO guidelines, and considering the number of workers involved and the sentiments of workers and the general public, the employer/ management should accept the union and come forward with a solution for the unrest. It was informed that they are ready to negotiate with the workers directly and not with the union. But this is unfair. In a democratic set up, union is a reality and it is formed for effective bargaining. Therefore, the attitude of the management should change.
