Respected Sir, My company has taken over the one establishment with 60-40% of share. The taken over plant was very old, so the mgt has decided to reconstruct / renovation with new equipment and civil structure. We have a factory license also. I have gone through the BOCW Act, noticed that Factory is excluded from BOCW except greenfield project.
My query is that
1. The present licensed factory of my mgt taken over will come under the scope of BOCW or not
2. Shall we require to pay cess 1% for all civil works.... or not
3. In the future if we will go for plant expansion, shall we come under the definition of BOCW
