Dear members,

We are faced with a very strange situation in our organisation. We have a internal Association which is recognised by management and is also registered. Our

COD was due for discussion with management but Association refused to engage with management on grounds that panel constituted by Association had name

of one of terminated employee and management refused to accept this name . This lead to situation whereby Association called off negotiations with negotiating team.

Employees seeing this stalement decided to form a commitee and enter into negotiations of COD directly. This consent was given by all serving employees of organisation and 98%

have given their consent to the terms agreed in COD.

Now seeing this trend GS of association has decided to affiliate our internal association with Trade union of Political party which has been opposed by all members. and as result majority

have resigned in protest.

Association has substential funds with it which can be misused by existing members(just 10-15 ) and employees want to stop them from doing this.

Please suggest any remedy available. Removing GS isnt possible bcos of his intimidating tactics(He himself has been terminated).

Any suggestion to solve this impass will be welcomed

Try this

1. Inform the management about resignation of all members from Union to form a non affiliated and independent body. This letter addressed to the Union General secretary must bear the signatures of all resigning members. Copy this to management and seek negotiations on basis of this break away outfit. You must also seek affiliation from any other Trade Union to gain industry recognition.. It will also give you legal sanction and the Management will be safe too. Please also remember that all Trade Unions are in some way or the other affiliated to some political party though their heads would have you believe otherwise. This is not a disadvantage but an advantage when it comes to industry stalemate where issues have to be raised in Parliament. I know you do not envisage such a scenario, but still it is always good to have the blessings of mighty people. Anyway the choice is yours.

2. Secondly this same letter- copy to the Bank where funds are parked and warn the Manager against this majority split in the organisation and therefore no funds movement should be allowed till the matter is sorted out and a new body recognised is in place. This should dissuade the Bank from acting on these funds.

Tks for yr inputs. As of now majority of members have tendered their individual resignations. Can we compile all of them and present as one consolidated bunch to both management and bank?.

Dear Rocks_72
Draft a fresh letter to the Management and get all resigned members to sign on it, asking for separate negotiations since you have lost faith in the present leadership. Also inform management that you will not be responsible for the actions of your present leadership/union. If needed attach separate sheets as allonge for purpose of obtaining signatures of members.
This same letter copy (duly received by Management) should be sent to Bank Manager and get acknowledgment on this letter too from Bank people.
