Dear Member,
You must have approach the company to find out the reason for denial of encasment of EL in the F&F settlement of dues. If they are not responding you & you are eligible to have this payment then approach the area labour office for their intervention.

Encashment of leave is applicable only in certain cases and in certain acts.
We therefore need to first have details of your previous company.
Which location, what type of organisation and which act it comes under.

have you severed your complete Notice Period, if not, then the company has the right to adjust your Notice Period with PL.

Not only balance of leave, but leave for current year has to be considered, on prorata basis of course.

There is no provision in any law applicable to india that requires the employer to encash or provide leave of the current year to an employee who is leaving the organisation

Saswat, you do not have knowledge, don’t misguide people. Check shops act & factories act. In both acts provisions are clear.

I keep reading both of those acts all the time because my work requires it. If you think the provisions are there, please quote them with sections. I would be more than happy to update my knowledge

Hey guys,
The management has ask me to leave after 2 days of my resignation. I have given them 30 days notice period in resignation but they didn't accept it they just said me to leave on 2nd day. Even I have the resignation acceptance email. And now they are denying to give my pending PL encashment which they are giving to all ex employees. And when my HR said this is not in policy so the management said then we'll give her termination and we'll not give her the exp. letter. Please help me that is management have authority to do so or not??

Saswat, Employee is entitled to leave till her / his last day of working on pro-rata basis. This quantum of leave should be added to previous balance, if any, and leave wages should be paid accordingly.
