please sugget one of my friend has resgined frm his compay & giving one month notice period, but the employer is asking for new company name, he has given name , now they r asking for offer letter also.
he worked for company for 3 year & he was very good performar, now he is trable that whether they will give him PF or not, or may be they will nt give him relaving letter. kindly sugget what he has to do.
Shall i tel him to take legal action ???

Yes, he needs to go other way if nothing working for him. He shouldn't hesitate to ask for his right. He served a notice period and resigning through a proper way so his employer doesn't hold any right to demand such things or deny to give relieving letter. Ask your friend to approach HR people or legal team and inquire about the reason behind such disturbing act and if he feels there is no flaw at his end, go for legal services.

1. Make sure that all correspondence and agreements are recorded and in line with offer/appointment order
2. Employer can't deny relieving letter, if the resignation is as per terms
3. If PF has been deducted till date, no worries, youe friend can claim it
Suggestion is not to get in to legal battle. Speak to HR or Top Management and sort out issues and try to amicably settle

If the company is asking for such information, ask your friend to politely ask the HR deptt, to put it in writing on company letter or email id with reasons for asking the same. If this is taken to labour court, it will amount to harrassing an employee and the company will face stern action.
Merely asking for what they want, in writing on company letter head or email id, will be enough to shut them up.

If the company is asking for such type of information and not agree to issue reliving letter, ask your friend to talk with HR Dept or Top level Management and ask to them the reason to not issue the reliving letter in written while he go through the term and condition of employment.

The employer is overplaying and they have no right to demand as stated. In relation to the present employment the employee had complied with as per agreement and going beyond is out of scope. Suggest your friend to demand the relieving letter through speed post.
No use coaxing with this direction challenged management indulging in such callous act.
Apropos the PF they cannot detain for whatsoever reason it might be. Once he gets the relieving letter rest can be dealt with appropriately.

Whenever some one leaves from their co.,some 1might have asked where he is going ,i.e,to next co.But,Yes ,he can directly reply where he is going.....thats not a big deal but something else harasses him then tell this matter to top management -like,GM-HR,or Dgm-HR.
First of all,he should put a mail to hr dept with relevant reason for leaving and ask for relieving letter asap.
I hope ,he will get a response and afterward he should have a face to face meeting.
For Pf,if they are avoiding his request then he can transfer it to that co where he supposed to work after one month.
