Hi Seniors, Please share the case law where PF interest and damages were waived off due technical error from PF deptt (the new unified portal could not process the ECR)

The PF Official cannot leavy damage and interest unless holding enquiry under section 7 A .
If the code no are not allotted to the firm/organisation they cannot leavy damage or fine as the same are related to the PF organisation efficiency and falls under their work ethics.
Also, as far as your question is concerned when the portal of the PF is at fault they cannot put interest and damage to the employer this can be sorted out amiably with the representations by the organisation in case such faults appear.
