Just to give an intro, I worked for Company A [5 years] in India. Then I joined Company B [Indian Company] in US-Onsite, almost 1 1/2 year back. So when I left Company A, I had PF account because I was on Indian Payroll. Now I'm in USD payroll - Company - B. Not enrolled in Indian Pay. I was told by HR from Company A whether I can close the PF and get the money. As per them, following are the 2 options.

--> For a Withdrawal, I need to provide a declaration Letter stating that you will not be working in any other company, since as per the PF New rules need to provide

--> 2nd option is Transfer.


Otherwise they won't be able to process. If both the option is not possible, amount will remain in the my account.

As per above,

I cannot go for option A, because I cannot declare I won't join/work for any company.

Also I can't choose Option B, because I'm not in Indian Payroll. No new P/F account to transfer.

How long the PF office will keep the money in my account ?

I would really appreciate, if could someone please let me know if there are any new PF rules about this declaration letter.

Dear Bala
Just fill up the Form-19 & Form-10C, take the signature of your employer of Company - A ( you already left ), and submit the same to Provident Fund Office.

Dear Bala,
For the Withdrwal of PF, on form No. 19 you need to give an undertaking that you were not employed in last two month. you should sign and send it to your employer on completion of two month from the date of resignation.

Thanks for the replies. Actually I submitted both the Form-19 & Form-10C with 1Re revenue stamp, duly signed, after 2 months I left from Company A and send it to my HR. After HR received the forms, I got the e-mail from HR stating that

As per below statement,

For the Withdrawal of PF, on form No. 19 you need to give an undertaking that you were not employed in last two month.

Hence got a doubt about this declaration letter. There is a possibility I can come back to India and work in Company B [Indian based]. In this case, should I keep my PF account open ? If thats the case, I can do the transfer from A->B account.

How long the PF account will be in open status ?

Hope I'm not confusing anybody. i would appreciate for your valuable comments.

After completing 60 days from the date of resignation, you need to submit PF closure form - 19 duly filled-in to your employer to submit the same to PF dept.
You shall verify your status by login-in EPFO and click the option "Know your status" . Generally procedure of PF payment is 40 days from the date of submission of Closure form.

your HR pesonnel has not given correct reply.you talk to them and ask where it is written.there is limit for 60 days and when you are filling form after 60 days you give declaration that you are not working presently,which is written in withdrawl form it self.
in your case even 60 days is not requried .if someone takes job outside india,his withdrawl to be done immediately.
you ask HR to forward your form to PF dept immediately.

I have to fill manually otherwise the company provide the 3A form?
