I am 4 month pregnant and my company is showing all signs of terminating me except that they haven't given me anything in writing. They have told me verbally that my performance is not upto mark & they haven't done the pip too. They haven't given anything in written though and and are asking me to resign. The HR is hesitant to give me termination notice. How should I proceed?

Dear Madam,
Their game plan is obvious -to deprive you of your legal right of ML.
Don't give in. Don't resign and stay put. Let them take any action.
You follow the procedure under MB Act regarding intimation to the company regarding your pregnancy with medical certificate .
If they precipitate any action, law is on your side.

Dear Vinayak, can you please explain why there is a condition of 80 days during 12 months in section 5(2)?

Dear T.K.Madhu, I do not know. But legislature surely may have some logic for 80 days while enacting this provision. You may enlighten if you know. Regards, Vinayak Nagarkar HR-Consultant

Sure, but the same objective should be there behind the words " 12 months". Enlighten me with relevant court judgement. People like me depend on you people because I am an employee of an organisation and not a consultant.
