Dear colleague

I am an employer in the government sector, have a doubt regarding the payment of bonus as the basic of contractual employees (security personnel) has crossed the ceiling i.e. Rs. 21000/-, whether they are entitled to get bonus or not. If yes, on what basis should it be considered to disburse the same?

Please advise as the Payment of Bonus Act does not explicitly state it.

The legal liability for payment of bonus would arise only for the employees covered as per the Act. Beyond the salary limit, there is no statutory requirement, but many organisations pay an amount they deem appropriate as per their capacity.
