Dear Sanjay,
Please go through section 79(3) of the Factories Act, 1948.
Statutory payment of Annual Leave with Wages arises under the Act only on the termination of employment of the worker on account of - i) discharge, dismissal or resignation
ii) superannuation or dieing in harness.
In the first case leave payment should be made before the expiry of the second working day from the date of exit.
In the second case, it shall be paid before the expiry of 2 months from the date of such termination.
