Hi All, One of our consultant claiming payment for below mentioned case:
We hired a candidate for Mumbai location through consultant but candidate did not join on joining date as he has withdrawn, however subsequently candidate directly approached us for a job at Bangalore location and we hired him as a contractor for sales profile.
Now consultant is asking for payment saying that we have hired his candidate. Please suggest whether we should pay or not.

The services of candidate, - sent by the consultant - is hired by you, though a little later. Hence, you need to pay the service charges of the consultant. The contention of the consultant is correct, as the candidate belong to the consultant.

Scenario 1:
Consultants are partners-in-progress. Therefore in this case, ethically paying the consultant for leading to this HR who has been now hired by your organisation but for a different location &/ position to what was initially is the right thing to do - the finer details of costs you must be able to negiotiate.
I would also find time to have a chat with the individual, now employed in your organisation, to help him appreciate the support the consultant has done for both himself/herself and the organisation as he/she also had used the services of the consultant to begin with but had to withdraw his application. Later as mentioned the candidate continued to keep a track of your company's vacancies and approached you directly. In this connection, I would like to say we do not know the reason why the candidate approached you directly (but it may be that he also has to pay the consultant his fee!. This is for them to sort out and nothing to do with you)
Scenario 2:
You can show this as cost saving but the risk of loosing a consultant who may or may not be a good head hunter and bigger risk of word of mouth through this episode may hamper your organisation's professional outlook.
