My friend is working for an IT company in India. His family is threatening him to transfer money to them or else they will file an FIR against him stating he has stolen money from his father 5 years ago. The said money at that time was given happily by his father to him for his marriage but now as they have tension in family, they are asking to give money back. He is innocent and afraid that if he does not agree to their demand then the FIR raised against him will impact his career and he may loose job as well. Pls advise what employer does to the employee against whom an FIR is raised.

The advice given here is based on the assumption that whatever you have written is true. Well friend, FIR is not charge sheet and charge sheet is not court's verdict. Therefore, have no worry.
For filing police complaint for stealing money, there has to be evidence. Genearly police personnel do not intervene in the family matters unless someone has done physical harm.
At this stage he might inform his employer about the ensuing fued in the family. However, if really FIR is filed then it he might not be able to quit his existing job. If changed the job then this pending FIR could pose problem as his future employer may not take your friend's version at its face value.

This is a strange situation. Cannot believe these things happen in this world. Adding few more point apart from what Dinesh has mentioned. Any FIR should carry a void reason. His father cannot raise a complaint stating that the money was stolen 5 years ago. That will not stand void before the court of law. Ask your friend to send in an email to his manager and HR personnel stating this. Also ask him to send that in such a way that he is seeking advice on the situation and not as information. This might help if a FIR is filed. Also a company cannot terminate a person unless he is proven guilty.

As replied by seniors above this is a case of Domestic feud hence the employee will not have any impact on his career until he is proved to be guilty or convicted with an offence.

Well my friend as per law, every incident / complain has to be informed to the authorized person in the stipulated time frame. The police will not take an FIR as this is an Time bared case and hence void and invalid.
Of course unless the parents want to trouble him and file an FIR stating that he has robbed money now, but again that cannot be proved in the court of law, as there will be no valid transaction in his bank account.
Ask him to relax & not even bother to inform the existing employee of the situation happening in his personal life. They will not understand and un-necessary their view and belief for him might change.

The police will not file an FIR first. They will file a CSR first. CSR is community Social Register. They will conduct investigation based on CSR. If they find something which violates the law, then a FIR may be filed and further investigation will be done. Even at this stage, if nothing wrong is found, the case will be closed. Filing FIR is not easy as it seems. So tell your friend not to worry.

The complaint may not be of any consequence, especially because the matter has become too stale and beyond the period of limitation.
