Could anybody please help me to calculate my Basic salary? Should it be 40% of gross? or is there any other regulation that came into effect?

As on date there is no hard and first rule to fix Basic Salary as % of gross or CTC. It depends on organization's policy.
As per new labor codes ( yet to implement ) it should be 50% of the total wages as directed in the definition of Wages under the Codes.
