Ministry of Labour has issued notification giving effect to all the amendments to ESI Act vide ESI(Amendment)Act 2010 with effect from 1st June, 2010.

1 Persons loading and unloading goods, whose activities are controlled by their employer, are covered. (Jain Plaster and Minerals- 2002(94) FLR.533; 2002(3) LLJ.141)
2. Mutha coolies avaiable on the spot for loading and un-loading ARE NOT TO BE COVERED. (Supreme Court- ESIC-v. premier clay products)
3. Hamalies/coolies/labourers who come with the transporter (Lorries etc.) for loading or un-loading in the premises of the factory are not covered. (Bombay High Court- RaiSahib Tekchand Mohate Mills vs. ESIC)
