Dear Seniors,

We have to release gratuity of an employee who was working with us at Gurgaon location for last 6 years.
Please advise how and where to submit Form-L (Notice for Payment of Gratuity) to the controlling authority in Haryana.
Is it possible to deposit online?
It would be helpful if you share the address to submit it.

The Controlling authority need not be informed on each payment of gratuity even though form L has a mention of Copy to the Controlling authority. The Controlling authority comes in to picture only when the employer fails to pay gratuity and the employee seeks the help of the Controlling authority to get hom paid the gratuity. Moreover, Form L is a communication to be given to the employee to come and collect the gratuity. If he permits you to remit the amount directly in to his bank account you can do so but before that please ensure that the form L is acknowledged by the employee so that he will not come with any dispute in future on the amount of gratuity, computation and length of service etc.

Thank you so much for your prompt reply and kind advise.
Till now we have been paying all eligible employees under Gratuity Act by NEFT directly into their bank account within 30 days with full and final settlement and also receive acknowledgement.
But our auditors informed us to submit Form-L to the controlling authority as per the compliance.

It is because the Rules say that a copy is to be sent to the Controlling Authority. Also there is no annual returns to be submitted to any appropriate authority. But here are a lot of such instructions which we can bye pass. Therefore, nobody cares to inform the Controlling Authority whenever payment if made. But if the Auditors says so, you can start sending Form L to the Controlling Authorities. But I would say that not sending it will be a serious non compliance but it could only be given as an observation by the Auditors.
