1) Is any employee working in a private company can do a part time job in other private company ?

2) Is any employee working in a private can join as an intern in other private company ?

3) Is there any legal complication may arise for employee as well as for both companies where she / he is an employee and intern ?

Hi,

If you are working as a Full time Regular employee then you are not supposed to do part time job in other private Company. Most of the Employers restrict the same and there will be one clause in the Appointment Letter restricting dual employment.

Alternatively if you are offering consultancy services as a Retainer for fixed hours then you may extend the service to other Companies as well.

While working as employee in a private company joining other company as an intern is not advisable.

Base on your question, here i'm answering the same one by one,

1. You have asked Is any employee working in a private company can do a part time job in other private company ? - No. Dual employment is not advisable. But as per the current scenario, if you have issued an employment offer with having no clause on dual employment. Then the said employee can do a part time job in any other organisation with haven't showing employment EPFO site. You have only one option the check the dual employment is EPFO. so, check your issued appointment letter. You haven't had chased the said employee about the dual employment with no evidence.

2. Is any employee working in a private can join as an intern in other private company ?- No. But if the employee is not the regular and full time employment with your organisation or he/she can engaged on hourly basis. Or if you have haired a manpower only hourly basis and haven't had no agreement regarding internship or dual employment.
