Dear sir, I want to know about the difference between the shop establishment act and the factories act. Please help me

Both are Acts to regulate conditions of service of workers engaged. While the Factories Act is applicable to establishments wherein a manufacturing activity is carried out the Shops and Commercial Establishments Act is applicable to establishments which do not fall under the definition of factory, mine or plantations. The Factories Act is a central Act whereas the Shops and Commercial Establishments Act is a state Act and as such there will be separate Shops Act for separate state.

If an organisation is covered under Factories Act, does its back office still needed to be covered in shops & Establishments Act

If the admin/ back office is situated outside the factory premises then it will be covered by the provisions of the Shops and Commercial Establishments Act. On the other hand, if it is within the factory boundaries only, then there will not be separate coverage but all employees will be covered under the Factories Act itself.

Dear friend,

I am unable to understand the reason or the context behind your question.

No of employees is a requirement based on various factors like the average volume of business transaction per day, the floor space of the establishment, the nature of the services rendered to the customers and the like. Hence it is a matter of pure business requirement left exclusively to the discretion of an individual employer.
Even if there is licensing/ registration provision, the number criterion would always be there for the purpose of fee to be collected only. That's why you will find the fee structure being fixed as " upto certain no"' in slabs and thereafter finally "beyond a certain number" only and not being limited to an exact number of employees.

Therefore, so far as I am aware, no State S&E Act puts a ceiling on the no of employees.

Major IT and ITES establishments which employ thousands of employees also come under Shops Act. It is a wrong conception that Shops and Commercial Establishments Act is applicable to shops employing a few number of employees. Take the term " Shop" in a wider perception rather than narrowing it to a grocery or pan shop!
