What is the procedure to inform accident intimation to DISH, Maharashtra under factory rule? Is there any statutory form available? Pls help.

Its called Form 24

Has to be sent within 24 hours in case of fatal accidents and within 48 hours in other cases.
Please note that separate notification has to be given for ESIC

Thankx a lot Mr.Banerjee.

But Factory Authority says that this form i.e.24 A is for Notice of Dangerous Occurrence. They require form 24 for Notice of accident report. Pls inform me what is the correct form to submitted.

Accident is accident. It means loss of something.May be small or big. Factories Act considers safety of workers. So when there is an accident the worker may resume immediately after say 5-10 minutes or just rest for that much period. A small cut, some bruice, stumbling, etc are accidents in which working time of worker is not lost. First aid or even nothing is required.

Some accidents are severe in the sense fracture, burn, big cut etc where worker is not able to work for 2 days or more. This is termed as lost time accident. These are to be reported to the DISH within 24 hours. How would employer know if the worker will remain away from work for 2 days? That is a judgement. If he feels worker would join next day, he need not send the report. But if worker does not report next day then emp0loyer reports then. Which is ok. Delay should not be much. Accident is to be reported to DISH and ESIC. ESIC requires the information to render medical treatment to worker. DISH requires information to study and suggest safety measures.

There may be a common accident register in which these accidents are recorded. This is a good record for future guidance. We can find out who worker is accident prone, which are accident prone areas or machines etc.

There is one more reportable mishap. In case of Fire, Fall of a building or wall, Death of worker, or any explosion it is called dangerous occasion. Magnitude is not important. Even if a grass heap catches fire it is to be rerported. This is to be reported to DISH immediately within 4 hours of its occurance. The reason is it may involve criminal liability of employer.

I narrate an incident. A worker died in an explosion. All workers became angry. Personnel Manager told Production Manager to go to Factory Inspector to inform the accident be he was needed to calm the workers. Production Manager went to Factory Inspection Office but Inspector was in a meeting. He waited for half hour. Then he went for tea. At that time the Inspector left office. Production Manager returned. Next day it was reported in Newspaper. Inspector came to enquire and charged with not informing immediately. He said he can be disturbed in a meeting, at midnight, in wedding or anywhere but report within 4 hours is amust.
