Hi, An employee recently resigned from my company where he worked 15 days and dropped written resignation stating that he will not be able to serve notice.
But the employee by mistake logged into his mail account so we agreed to mark the 16th day as the last worked date after he negotiated his notice period.
But the employee has joined another company on the 16th day and asking to change the last date to the 15th as his relieving date is clashing with the current joining date.
Can an employer, can change it to 15th knowing the fact that logged in hours are not more than an hour?

There is no issue in changing the last date of working to 15th day provided he has not performed any work after logging in, may be accidentally. If he has worked then nothing can be done as there exists adequate proof thereof and it will not be proper to disregard it.
