Presently in our firm 500 employees are working. We are giving the bonus monthly with salary now i have a problem for calculating/preparing bonus return so there is a difficulty for analyzing where i.e. in which payment sheet he will be present, and it is time consuming so pls instruct me for this problem how it will eazy for preparing the Annula Bonus return whole (500) employee .

I Want to know that if bonus is mandatory to pay if an organisation is suffering losses from last three years. Kindly also If one has not submitted Form D on Time ,can form D be submitted later (On march & April)

There are so many changes in Central Labour Rules. At present the RLC/DLC advised not fill Half Yearly returns for LIN seeded Establishment. Only the Annual Returns for the same. Please Which is the correct? Please clarify .

The Payment of Bonus Act,1965 and The Bonus Rules, 1975 is applicable to all establishment where the manpower on any day during the financial year is 20 or more.(pl.refer sec.1((2)(3) (a),(b). And when it becomes applicable, the establishments obligated to adhere to the provisions of the Act & Rules, shall submit the Forms & Returns in Format A, B, C & D attached to the Bonus Rules, 1975 which shall be maintained in the form of a Register(s) as per "Rule 4.Maintenance of Registers" and the Unified Annual Return in Form D (amended from 2019) shall be uploaded on the web portal of the Central Govt. in the Ministry of Labour and Employment furnishing information as to the particulars specified in respect of the preceding financial year "on or before the 1st day of February each year". (Ref.Rule 5 of the PoB Rules, 1975. Provided that during inspection, the inspector may require the production of accounts, books, registers and other documents maintained in electronic form or otherwise. This Rule has been amended/introduced by a notification G.S.R. 58(E), dated 29.1.2019 (w.e.f.29.1.2019. All please take note of amended Form-D - Unified Annual Return, which is to be "uploaded on the Ministry of Labour portal. This Form D published in pdf form. In excel format is not readily available. The amended formats are required to be filled with many details & computation as in Form A to C and form-D to be uploaded on the portals. It will be difficult to collect, group required data for the whole year and fill in appropriate columns. This will call for coordinated efforts of Finance/Accounts & HR. I would advise the concerned to commission a suitable software linked to your pay roll, especially where more no.of employees' data to be collected and fill them in the formats. Otherwise manually it is not possible to collect and put in places.
So far as the computation of bonus payable the formats A-C are to be filled. I suggest the concerned shall prepare Excel sheets, fill the data. if these are prepared as soon as the audited annual financial accounts are available and determine the payable amounts of bonus persons wise. I'm aware in small establishments fix & disburse bonus amounts on individual basis as the empowered top level management fixes different amounts to different employees knowing well individually as to their contribution, dedication, potential etc. Whereas other bigger establishments fixes amounts at certain % age, may be after agreement with unions commonly applicable either as a whole or in groups. This ranges between statutory 8.33% & 20% and more also possible. This stipulation is as applicable irrespective of whether the establishment earn profit or incur loss. Pl.take care loss incurring establishments also have to pay statutory bonus at a minimum of 8.33%..
