With respect to the BOCW Act, we have been providing security services at one of the construction sites. The company is deducting 1% labor cess from our monthly bills. Could you please clarify if it is correct to deduct 1% labor cess from the security guards' monthly bill?

Dear Venkat Please check whether the 1 % being deducted is for TDS under Section 194 or it is deducted for BOCW Cess.

Dear Venkat,

BOCW 1% Cess is not only applicable to BOC work as stated in the definition, not otherwise. Security services do not fall under the ambit of the said BOC Work; therefore, it is not applicable to security services.

Please clarify if any SEZ developer or a unit in India has applied for exemption from payment of 1% Labour Welfare Cess and has received such exemption from the Central Government under the BoCW Act 1996.

I have taken BOCW registration for the estimated sanctioned period, but our project is not completed in the stipulated time. We have received a project extension of time from the Principal Employer. So, I want to know whether BOCW registration renewal is required or not. Please clarify.
