Thanks for the information and in addition to that, BOCWW Act - 1998 , have special focus on Welfare of Building Construction and Other construction worker. And also Act directs to concern governance body to proper use of that cess on this Labour but its not happening in entire India.
Here, cess liable only on such cost where worker involved/worked in construction and worker related expenses which directly included in project cost. Land value and compensation cost are direct cost and investment of principle and workers are involved only alteration of Land with Wages and Compensation is part of any damages to worker.
I think, its totally justifiable!!!!

Eventhough you are in search of answer to some question, it should not injure anyone's feeling. As a matter of fact Mr.Keshav is a regular and senior member of this community and we are all learning from Mr. Keshav from Day 1 onwards. He is the person who clears the doubt in Law related HR doubts.
Your doubt is not concerned with the subject. It can be answered only after analysing the case and not on the records. Whatever you asked, I asked myself in 2006 itself, while reading the BOCW Act, Rules and BOCW Welfare Cess Act. The answer which I gave may not be correct because it is only my perception.
But whenever and Whatever Mr. Keshav gives reply is a foolproof and without any second opinion 100% correct. So do not belittle anyone.
We all are here only to take help from others and assist others who are inneed of any assistance.
All are having the right to answer and deny to give answer. So please stop giving your advice on others comments. If you feel then accept the answer or you are having right to not to accept the answer. But here we do not want to know the reason for not accepting.

When doing the project construction cost estimate, what items are included/excluded in the CESS assessment Form I ?
Without being pedantic, law says everything 1% on entire project cost except land cost. But in reality it mostly depends on the assessing officer. I heard that certain items can be challenged (Elevator, as it can be construed that these are not part of "construction cost"
Does anyone have experience of such item list ?

we have taken Plans approval from Dept of Factories for plans approval and subsequently License to work a factory, now BOCW issued notice saying that, we need to pay on the total project cost, which includes Imported machinery, does machinery component attract BOCW...
