Hi Risha,

In general course of operation, salary slip has to be issued to an employee to have a definate idea of his / her earning / deductions etc. In smaller organisation, it is overlooked and is given minor significance. In large manufacturing establishments / factories (those who come within the ambit of Model Standing Orders) there is usually reparate section under HR which deals with this. They have to keep records in prescribed format as per Factories Act. For various inspections like EPF, FP, ESIC, Proffession Tax, Labour Welfare Fund, Yearly Bonuses etc the respective competant authorities/ inspectors may demand payrolls for the inspection period for their scrutiny.

For income tax calculations and deduction of TDS from employees, an establishment has to keep a record of employees earning dtls across FY concerned. In view of this, not only issuing the employees with their payslips but also keeping the payroll records and preserving the same across years is mandatory.

Dear Sir,
Giving salary slip is to know the details of Pay days and to look at the salary prepared by you is correct or not and to know the deductions and net salary
he is getting. Signing in the counterfoil is not necessary. If he refuses, don't worry. Leave him by explaining that everybody is signing, he should also follow.
If he desists-leave him. Action cannot be taken in this regard. It is his will whether to take the slip or not.

Dear Mr. Gurumurthy
Thanks. However, we are not concerned whether he takes the salary slip with him or not. But he should sign on the salary slip which is kept in the company. This is asked by the auditors and also as per labor rules, its required. So in such case, what action can be taken against such employee.

well there is no legal requirement.
no legal punishment
no harsh step to stop payment or resignation
bank documentation supports your account
at the most you can have documentation (inform)your seniors that he is not signing
do not give importance to such minor issue

keep yourself away from idea of taking action against him for his attitude< just he is not signing pay slip>
auditor will not put query. If they...say pay slips are prepared & given to all
your duty is to have pay slip... that you are doing. that is enough...

Salary slip is a record which proves that the Employer has paid the employee the Minumum House rent Aallowance.In Mahrasthtra ther is a Seperate Enactment.
Salary slip can be record to be maintain under this act.
