Hi,
Forget. If employee does not want to work with you why are you worried. Secondly, what you will recover from him? For two momths salary how much time your leagal team, lawyer will sent?
I suggest to do the cost analysis and close the case.
And work how you can work on improvements.
1) Was the hiring bad? why?
2) Why he left? How can you ratin employees.
3) Why he has not bother to communicate HR about his leaving?
You need to look into your culture and HR practices.
