As per Gratuity Act minimum 5 years of contineous service is mandatory. However based on Madras High Court judgement (After the ruling of Madras High Court an employee is deemed to have completed 5 years if he has completed 240 days of service in the 5th year.)some Employers are releasing Gratuity based on above criteria. But there are different interpretations for the above judgement. You can apply for Gratuity and check with your employer.
