Navigating Probation Period Notice Period and Resignation Process - CiteHR

Hello,

Currently, I am working in a company and need to resign from the service within 6 months of joining. My current organization did not mention anything about the notice period in my offer letter. I can leave without a notice period. Please suggest.

Hi Buddy,

If there is no mention of a notice period in the offer letter and there is no discussion about the same with your employer during taking up the employment, then yes, you can leave without serving a notice period.

Hello sir,

Will my company issue a release letter with a certificate or not? Kindly elaborate. I have not signed any agreement regarding the employment contract. I only signed the pages of my offer letter and reverted back to them.

Buddy,

My suggestion for you is to please stay in an organization for at least one year, learn everything, and gain experience. Don't shift jobs often as it is not beneficial for wise people. In the future, organizations where you intend to join will also look into your track record of experience. When you leave your organization, they will provide you with a relieving letter.

I will always try to maintain your valuable suggestions. I am really grateful for your reply. However, I worked at two organizations (2 years and 4 years) before joining my present company in July 2015. Unfortunately, my current company is in the telecom sector, and the work culture is very poor. I am required to work three night shifts continuously (8 pm to the next day 10:30 am), which is affecting my personal and health life negatively. I was not aware of this schedule before joining.

Moreover, there are monopoly-like rules enforced by the team lead. I am not even informed of my next day shift until 9 pm the day before. The situation has become critical, so I have decided to leave.

Dear Sudip,

You mentioned that there is no clause in your appointment order regarding the termination of employment on either side during the probationary period. It is advisable to submit your resignation in writing and request immediate or early relieving. Please ensure to take acknowledgment on your resignation letter. Subsequently, the company should provide you with a relieving order. This is a common practice in the HR field.

You can resign now if the situation is the worst. The company will issue a relieving letter to you. However, it is better to resign after 6 months for your career growth. You have to face the difficulties and learn from them.

Termination Clause in Offer Letter

Please note that the following clause is mentioned in my offer letter, which I signed and returned to them:

"The Company reserves the right to terminate your employment summarily, without any notice period or basic salary in lieu thereof, if it has reasonable grounds to believe that you are guilty of gross misconduct or have committed an act involving moral turpitude or gross negligence."

Nothing else is mentioned regarding my notice period or probation period in my offer letter. What can I do? Please suggest and help me. They can't force me to serve the notice period. If I resign with a 1-day notice period, will they issue a release letter in the next action? Please help.

Dear Mr. Sudip, The first clause represents the termination of employment from one side, i.e., from the company's side, but it should normally be from either side. However, the clause is silent on whether this occurred during the probationary period or after confirmation. The remaining clauses represent misconduct, which, in this case, does not matter. You can take the opportunity to submit your resignation letter in writing, give one day's notice, and request for relieving. In fact, they should not force you and must follow the procedure for issuing relieving orders. Please adhere to the same guidelines as mentioned earlier.
