Dear All
I m new in my company & i am doing all ESIC & PF related jobs for our company.
Now two new employee are not agree to registered themselves as well as dont want contribute any amount although we told them about benefits. and i m sure they will never agree.
What should i do so ESIC will not charge us against violation of rules.
Please help me.

Hi Achinta,
No way it can be. It is mandatory to deduct the ESI contribution and pay to ESI failing which the ESIC will sue the company. If the management agrees you can pay the employee and employer contribution from the management side but you can not avoid the payment to the ESIC.
To avoid this type of criticality you have to communicate to the employee at the time of issuing the offer letter and they can't avoid the statutory deductions, if you agree this tomorrow some people may ask you not to deduct Professional tax and even the Income tax also hence better to comply
