Could any one of you can tell me whether an M.N.C (Having its H.O at USA) in india which is registered under STPI need to facilitate P.F. contributions to their employees or not.
Please make me aware of this point.

Contribution to a Provident Fund plan is mandatory for a company having more than 20 employees. Both the employee and the employer must each pay an amount equal to 12% of a portion of the employee’s base compensation into the Provident Fund plan.
No compnay is exempted to this including STPI registered IT Units.

We would like to state that the Employees's Provident Fund & MP Act, 1952 applies to your company as well according to the following:
Section 1: Short title, extent and application:
(1) This Act may be called the Employees’ Provident Funds and Miscellaneous Provisions Act, 1952.
(2) It extends to the whole of India except the State of Jammu and Kashmir.
(3) Subject to the provisions contained in section 16, it applies –
(a) to every establishment which is a factory engaged in any industry specified in Schedule I and in which twenty or more persons are employed, and
(b) to any other establishment employing twenty or more persons or class of such establishments which the Central Government may, by notification in the Official Gazette, specify in this behalf

Dear Friends,
Thanks to one and all who responded to my mail by spending their valuable time on the above subject. Basically, i do have the knowledge of the statutory obligations as i am having 5years of exposure with manufacturing concerns dealing with core HR activities. But the issue here is recently i joined a software company where there is no subscriptions to the P.F.
Where as, i heard that most of the software companies which are under the age of 5years are exempted from paying P.F. when they are been registed with Software Technologies park of India (STPI).
I was been informed by many people that most of the software companies at hyderabad do not subsrcibe for P.F. as they are exempted establishments.
It would be appreciable if any body can clear my doubt with a substantive material enabling me to be the upper hand in subsribing the P.F for my company.
