I have a query;

In a scenario where an employee\'s salary exceeds the PF limit, thereby exempting them from PF deduction, but due to absence, their gross salary temporarily falls within the ceiling limit, what are the implications?

The Provident Fund (PF) scheme under the Employees' Provident Fund and Miscellaneous Provisions Act, 1952, is applicable to employees earning up to a certain limit (currently INR 15,000 per month). If an employee's salary exceeds this limit, they are 'excluded employees' and are not required to contribute to the PF. However, if due to absence, their salary temporarily falls below the threshold, the implications can vary.

For one, even if the gross salary falls below the PF limit temporarily, if the employee has already been categorized as an 'excluded employee,' they will continue to be excluded from the PF scheme. The temporary reduction in salary due to absence does not change their status.

However, if the employer voluntarily extends the PF benefits to such employees, then the PF deduction would apply on the reduced salary. The employer can also choose to calculate the PF contribution on the full salary (above the statutory limit), but they are not obligated to do so.
