What is the current definition of completing one year. Is it 240 days OR 180 days. Questing is : if an employee completes 4 yrs and 180 days, can he is eligible for Gratuity.

In India, 240 days means 240 days and not 180 days. If an employee completes 4 years and 180 days, he will not get gratuity. It is mandatory that he should complete five years from the date of joining. Of these 5 years, each year should account for 240 days if the employee is working above the ground or for 6 days in a week or 190 days if working below the ground (of a mine) or establishment which work for less than six days in a week. If in any year the employee had not worked for 240/190 days, that year will not be counted as 'continuous' and qualify for gratuity.
