In the death cases the service conditions attached to payment of gratuity will not be applicable. Therefore, you should pay gratuity considering a service of one year. The amount will be 15 days salary. If you have taken any death cum gratuity scheme, forward the matter to the insurer.

If the accident resulting in death has happened during the course of employment, then his dependents should be paid compensation as is required under Employees Compensation Act. If covered by ESI, inform the ESI of the accident and death. The ESIC will take care of the compensation part.

No minimum eligibility period in case of death or disablement.
The gratuity amount depends upon the tenure of service and last drawn salary. As per the Gratuity Act, the gratuity is payable up to the date of death irrespective of whether he completed five years or not.
