I am not from India, but I do have a few questions about labor laws governing Pune/Maharashtra.

Is there any legislation that would classify students as employees, depending on their duties (such as working in clinics)? Even if these students are not entitled to *any* form of remuneration (not just wages), is there legislation that governs working hours by unpaid employees/students?

I understand these may be complex questions, so I do not necessarily expect direct answers. If someone could point me in the right direction (like a particular provision of an Act), I would greatly appreciate it.

Hi,

University / College Students who are yet to complete their Degree / course cannot be classified as employees but they can undergo internship to gain professional learning experience in any organization which is related to their field of study. Undergoing internship is a good opportunity for career exploration and development, and to learn new skills

Internship as part of curriculum only is excluded from the purview of labour laws in India. At the same time, students doing part time employment will be considered as employees only. Therefore, the employers who engage interns should possess a declaration from the Principal or such competent person of the College/ University to the effect that they are students undergoing XXX course and the internship is as part of their curriculum.

Hi,

Absence due to sickness for one or two days will not be a criteria. The Intern should inform about his absence to the concerned organization about their inability to attend. As an Organisation we will not mind the period of absence for one or two days and the Internship completion certificate will be issued to the Intern for the whole period start to end.
