We are planned to working on August 15, which is a national holiday. We are coming under factories act. The question is how many times of wages need to paid or any CH need to provide for that day. Actually, we are paying festival wages and a one-time salary. Is that correct or else need to pay two times of salary in addition to festival wages. Kindly clarify valid legal points.

Dear Member , you otherwise have clarity in yourself about the position of law except for the fact that you are practicing differently.
As per settled law ,three paid national holidays are compulsorily admissible. For making someone to work on national holiday, one would be entitled to payment at the rate double of the daily wages and Compensatory Off which should be given within 90 days of national holiday or holiday for which employee has worked .

Dear friend,

Please go through the Karnataka State Industrial Establishments ( National and Festival Holidays ) Act,1963 which is applicable to your factory.

As per section 5 of the Act, the compliance is as follows:
a) The employer can allow the employee to avail the holiday with wages on that holiday
OR
b) Require him to work with twice the wages OR allow him to avail a substituted holiday with wages.

Twice the wages means one day's wages in addition to the normal wages for that day.
