Basic condition for entitlement to gratuity is 5 years continuous service. With your 3 year gap, continuity is broken. Entitlement to gratuity does not arise in this case.

Hi Manisha,

According to the Payment of Gratuity Act, if an employee is relieved from the organization, their service will be considered interrupted. Upon rejoining, the service will commence anew. In this scenario, gratuity for that 3-year period will not be applicable.
