My wife is working in XXX hospital as a nursing officer from last 3 years and she was on maternity leave from 6 months and now his accountant is saying that she will not get any salary is he right?

Hi, if the establishment she works for comes under the Maternity Benefit Act, she is eligible for Maternity Benefit. Hope your spouse has made a request in writing one month prior to maternity leave. If she is covered under ESI, she can claim Maternity benefit through ESI.

Anyway, ask your spouse now to make a request in writing to the Employer for maternity period salary along with proof of birth. In case of denial, she can represent the same to the local Labour officer. No employer can deny Maternity Benefit when they fall under the purview of the Act.
