Dear SIr, I am previous employee Future Enterprises ltd work since 13th nov-2013 to 29th oct-2016 i Gurgaon after leave the job i apply for the Pf final withdraw but it rejected due to my date of birth mentioned wrongly by company which is company have 1 portal which employee can update the attendance, leave process, and many of data so i have not check that my date of birth is mention wrong this why my pf claim is rejected, as per rule this is HR responsibility that each & every employee data should be update, i have submit every document with joint declaration form for update this Date of Birth but still not resolve, even i apply in PF GMS PORTAL also but they saying contact PF Kandivali Regional office which is in Mumbai & our HR also reply this is not our hand your problem should be resolve Pf office in Mumbai only. Now tell us is this the way to work by company. Kindly suggest us what should i do for my PF final withdraw can i apply labour court against company ASAP.

They have asled you to submit a form 11 to fill your data and submit KYC documents, and on hat basis only they generated your id in EPF or ESIC
aadhar has taken form in 2014 so it may be not available at the time of joining, but before leaving the job you must had to check your KYC duly verified by employer.
now you can update your basic data info (as per aadhaar) in member uan portal and ask the employer to verify the same digitally. if DOB diff is less than 1 year department will do it, in case of dob diff is more than 1 year then the employee has to rush to EPFO, employer has no role in it, as they were bound to approve KYC uploaded by the employee,
