Bombay High Court vide order dated 15.10.2018 (copy attached) has directed Commissioner (TDS) to file comprehensive affidavit in the matter of delay in issuing Form 16 by employers to the employees. Court has also directed Department of Revenue to penalize such defaulters and take strict action against them u/s 405 of Indian Penal Code. This is just for your information.
