We are a Private Limited company having several factories and branches across the country and covering all our employees under one PF Code. However, by mistake one of our factories has registered their establishment and got a separate PF and we would like to close it now. We have requested the regional pf office narrating that all the employees under that factories are being covered under centralised PF code and request to close but they are not accepting the same.
Kindly advise the procedure and further steps to be taken to prevent future problems.

Section 2A of the Provident Fund Act, 1952 provides for clubbing all departments and branches of an establishment under one head. But the issue remains as this factory is already registered as a separate unit. Then, you will have to build up a case that this factory has no separate existence, it is dependent on the other units for its existence, the functional and financial integrality amongst all the units, common ownership etc. You may apply to the respective RPFC but is not likely to agree, you may have to file writ petition before the High Court to compel the PF authorities to act as per the said provisions.
