I run a small private limited company in Delhi and we are into dot com sector. I need to understand what should be the minimum leave policy for my company.
Is there any document available that I can refer for complete details. How to calculate per day salary to be deducted for leave without pay. Which are the holidays that I need to compulsorily provide to my employees.

Please refer Delhi Shops and Establishment Act to know about the provisions of employee leave. You may give more number of days of leave than prescribed in the act but not less. Employee leave is linked to the attendance of the employee.
I do not know the exact provisions of the said act however, roughly for every 20 working days, employee becomes eligible to take a day's leave.
There are 365 days in a year. When you deduct 52 Sundays and 10 national/festival holidays, you get (365 - (52 +10)= ) 303 working days. When you divide 303 by 20, you get 15. Therefore, each employee is eligible to get 15 days earned leave per annum.
Please check provisions of Delhi Shops and Establishment Act to know whether act mandates for casual leave, sick leave etc.

According to clause 22 of Delhi's shops and estb act.
(a) after every twelve months', continuous employment, to privilege leave for a total period of not less than fifteen days;
(b) in every year, to sickness or casual leave for a total period of not less than twelve days;
However, I need to know :
- how many day's in continuity they can take these leaves ?
- Are these leaves paid or unpaid.
- If the employee is absent without taking prior permission can he/she claim it as his paid casual leave ?

PL is earned leave.
This leave accrues after days of working let us say for 2o days of work one day PL.
Suppose 10 days PL has accrued then he can be given 10 days EL at a stretch.
There is a policy of leave encasement at time of retirement.
Leave is a privilege and not a right.Employees are expected to take prior permission before leave.
In case of absence w/o permission it can be made leave without pay.

Just need a little more insights for a small company basically a builder. How many days leave can be allowed for an employee in a year. is it mandatory that we provide leave apart( how many no of days) from Sundays and national holidays.

The following annual leaves with pay are applicable for the employees under Leave policy under Delhi Shops and Establishments Act, 1954. Earned/Privileged Leaves (after every twelve months’ continuous employment): 15 Nos
EL is calculated as 1 day leave for every 20 days worked. This is a leave you earn after working for 20 days. A person earns it and it is accumulated. He can avail it only in the next year or working after 240 days. A trainee also earns this leave but he can not avail it during his training period. He can en-cash it if he resigns during this training period.
1. Casual Leaves (leave for urgent or unforeseen contingencies) : 07
2. Sick Leaves (Leave on account of sickness or illness) : 07
Apart from these, 11 Gazetted / Festival Holidays are also given to all the employees. Close Day Holiday : Every shop and commercial establishment shall remain closed on a close day (which will be notified by the Government) and such day will be a holiday for the employees. In addition to the close day every shop and commercial establishment shall remain closed on three of the National holidays each year. It is better on your part to contact the Labour department of your area to have better clarity & understanding.
