What is correct way making of salary. 30 days or 26 days
From India, Ghaziabad
some company paid to 30 days and some company paid to 26 days. what is the correct .

If u r working with principal employer - then it should be count on 30/31 days considering the month.
If u r working with contractor - then it should be count on 26 days, the per day cost fixed by the labor authority, which keeps changing every six months or according to state norms.

In very simple understanding in case of workmen which is governed with minimum wages the number of days shall be 26 and others who are getting salary the number of days shall be 30

Either ways it is correct. While considering 26 days formula you divide monthly gross salary by 26 days to arrive at one day wages, in such case weekly off is not considered as paid day. In other case you divide monthly gross salary by 30 / 31 days to arrive at one day wages,
Now if we calculate OT wages they turn out to be less by 30/31 days formula. Hence it is advisable to consider wages on the basis of number of days of the month, and not 26 days.

Hi,
As per employment laws, every employee will be entitled to one day off with wages after 6 continuous days of work. The working hours can not exceed 48 hours per week. Any additional working hours will be governed by overtime rules.
So, employees on permanent employment will be paid as per agreed monthly wages as per their appointment terms. Daily wagers will be paid as minimum wages notified & will be paid for the additional 1 day after every 6 days of work.
Payment of wages act does not differentiate between workers hired through contractor or directly hired by the employer. The act applies universally to both.
However, calculation of gratuity amount is done basis 26 days.
