Dear Senior, We have a small company & registered under EPF & ESI. Our total employee no. 22 (Twenty) . Now 20 employees have already registered to EPF as member but 2 employees till not registered as they have joined newly as probation period.
Now my query :
1. Is there any rules under EPF or ESI for unregistered employees
2. Should we register of them.
3. Is there any duration for probation period.
Please help me.

Membership of employees of PF & ESI starts from the date of joining based on the employee's rate of wages. Therefore employees should be covered during probation period.
Duration of probation period is mentioned in standing orders act. Since applicability of the act depends on your employee strength, check this. Even if act is not applicable 6 month probation period will be reasonable for employee to decide compatibility & employer to decide role-fit.

Dear Sir,
Probation or confirmation are your internal matters. If you are covered under PF code, you have to register new employee from day one. As at the time of inspection when PF inspector will see your balance sheet and their salaries without PF deduction. then you will have to pay it with damages and interest instead pay it today to avoid that. Because inspection could happen after 5-6 years. consider paying that much of interest and damages.

Dear Titan,
These Acts acknowledge only the term employee they do not recognise the status whether permanent/casual/temporary/badli/on probation/on contract etc. Hence you are required to cover them subject to eligibility.
