If the company denies to give even compensation any legal action can be taken by employee. Kindly furnish the details of the company (which is not a factory). What Labour law says about claim on accident happened to the employee while he is at work. what are the precautions can be taken to avoid such instances. what kind of protection can be given by the company to employee?

By way of supplement normally Companies do not miss out on Workmens Compensation Insurance.Sometimes if a Claim is made it is likely to be settled by the Insurer [if all the documentation is proper] without going to Court.

Accident generally is caused by two reasons, Unsafe Condition and Unsafe Act. Now any accident if it is in the course and out of the course of employment, the employer is liable to give compensation to the employee under Workmens Compensation Act. The employee has to claim at the dy. comm.office.
How ever if the company can prove that the accident was due to not following any given safety instruction, the employee is not eligible for compensation.
Compensation is calculated as per W.C Act.
