Few weeks back I had requested for details about number of leaves for a SW organisation as per the act. From the peers feedback I understood that any SW organisation has to follow the Shop and Establishment act. Since we are in Tamilnadu ,we have to follow the rules established by TN govt on this. On going through the Shop and Establishment act of TN, I found that a total 36 days of leave per annum is to be given to employees.CL- 12,AL / EL - 12 and SL -12.
However on checking with a HR consultant , we found that most of the SW org, in Chennai are not following this rule and consultants are guiding other organisation to whom they are consulting not to give 36 days holidays since the govt inspectors are not checking this and even they have not raised any objections.
Is this true? I already worked in few SW Org's in Chennai including MNC's. There also the leaves are less than 36. Please clarify me on this.

If a government official is not checking and not raising any objections does not mean that no one will check and raise objection in the near future.

The difficulty of the employees getting their eligible leave from the managements of target-driven private enterprises is well known to all.But the companies mentioned in the post do not provide for all the types of statutory leave is really shocking. Then how they avail of the self-certification facility under rule 16-C of the TNSE Rules,1948? Better, make a complaint to the Commissioner of Labour, D.M.S Compound, Teynampet, Chennai-6.
