Dear Members,
I have resigned one month back because my parents are unwell and my presence with them is required. I have shared medical certificate of doc too with my manager and HR.

My manager is harassing me and saying whatever happens to your parents, I don't care and you have to complete 3 months NP as business requirement, however there were ppl senior to me and he waived off there NP and were allowed to leave the org in 10days. I shared that I understand my responsibilities for business too and will provide complete download and KT till May end so that business is on track. However they are not listening and imposing there view point as a dictator.

I am not in a position to buy out my NP and he along with HR are saying that if you cannot pay then we will terminate your contract and cannot relieve you on compassionate ground.

If required I can take termination because I have to take care of my parents, however need your help to understand that in court of law/labour law, this act of organization is justifiable?

Please help.

Your duty is right now for your parents.
Write to higher official in your company and also point out in polite manner that other people have been allowed to quit on 10 days notice and that your manager is not showing humanitarian concerns.
Do not think of legal proceedings and you need time to care for your parents.
Organisation cannot do anything to you legally in an easy manner.

Dear Gaurav,
You have mentioned that people were relieved in 10 days, have they been let go after they paid the Notice period or not is no know to you. If the service conditions mention 3 months notice period, then the company has all the right to ask you to serve the entire notice period and deny the recovery towards the same.
Also you can request the management for early relieving, but not demand the same.
Speak to higher management on the same, with your problems and not the comparison with others.

Thank you Sirs for the reply, ppl who were relieved didn't buy out NP, it was waived off by my Manager, when I requested my Manager, out of shear grudge he is harassing me. Have escalated to top Management, hope they listen to my request.

In most companies, H R or the bosses are reasonable. I can see that they don't believe that your parents are really sick. They also know that medical certificates can be easily obtained. If it is a question of looking after ailing parents, one would seek long leave, may be unpaid, but no need to resign. But apparently, you have another job in hand, your new employers are pressurizing for early joining and perhaps, this is what your employers believe. If you are right, you should be able to convince that you must be with your parents.
Be genuine, and they will understand. If you have created a story, to join somewhere else, they will not budge. Forget about legal options.

Hi, Thank you for the reply. When I suggested for long leave for that too I am being told to ensure that work is not hampered. I am not in a situation to ride on 2 boats. I have shared proof, lets see what they decide.
