We are an educational institution,sometimes we hire labour for 3-4 days sometimes with a contractor and sometimes without a contractor.My query is should we put them on ESI.As most of the contractors are not registered under ESI for their laborers and all of the laborers that come here do not know about the ESI.So what exactly should we be doing ?Can we not have any labour cost bill that is not under ESI as our Institution is covered under the ESI for the staff that earns below 15k.Request someone to please reply on this at the earliest

ESI is applicable on every worker whether its a permanent or contractual & the duty of depositing the ESI fund is primarily on Principle Employer so one cannot escape from his liability by saying that contractors are not registered under ESI Act here I am not pointing out you but suggesting you to follow the appropriate Law. So you have to deduct the ESI amount & I have seen during the inspection ESI department points out the labour & maintainence cost to calculate the ESI contribution result in heavy damages for Employer.

In case if interested, pl contact us so that we can cover the individual workers on the day of engagement itself and pay both employee and employer's contribution in our code numbers. We may also pay the wages as fixed and claim the amount subsequently on monthly basis. This will absolve you from the liability of payment of ESI contribution and also from all risks in the engagement of casual / contract workers.

Here the people will be hired for 3 to 4 days and they will be gone. After some time some others or the same previous people come for such a short period. These are casual labourers having seasonal employment.
Is employer bound to pay ESI contributions in the above situation? What about EPF contributions in the same scenario?

Any casual contractor worker working in any month in single day we have to deducting the ESI our bill amount 30% Deducting ESI contribution amount 6.5% Thats right pls tel.
