i am getting a salary of rs.32000.00 and from april co. stop deducting the pf contribution from us and there end and replied us the norms has been change so the staff above 15000.00 will not get the benifit of pf.
when we asked for the refund of amount in pf they hand over a form in which it is written that we are regining from the job from april but still we are getting a A/C pay direct debit salary in the bank.
what are the norms of pf is still confused to employees and co.s are taking the benifit of it, please clarify.

Once you are a member of EPF, you are a member of EPF till such time you are in employment even your salary exceeds the threshold limit of Rs. 15000.
Your company is engaged in unfair practise by taking resignation from you and appointing you again with no EPF.

Actually even that would not work.
The rule is that starting salary of the person must be above ₹15,000
And he must not be a member of the PF scheme at the time of joining the job.
In case of a complain to the PF authorities, the employer would be in a problem

Dear Adya,
As Mr. Korgaonkar K A posted, even if the salary cross ceiling limit PF remittance cannot be stopped. That is why the employer asked to you to give resignation. Hence continue in service. If the employer is not remitting PF, kindly contact the concerned EPF Enforcement Officer.

Definitely unfair practice by the employer. As mentioned in other posts, an employee will continue to be covered under EPF & MP Act if during the course of employment the Basic Salary and D.A. go above Rs. 15000/- (earlier Rs. 6500/-).
If the employee was getting Rs. 32,000/- p.m. and was covered under EPF before April, 2015, the employee will continue to be covered.
By resigning w.e.f. April, 2015 and rejoining immediately, there is a problem as an employee can make a closure of PF A/c only if he has been out of job for two months after resigning from previous employment, and the new employment is in an establishment not covered by EPF.

Dear Friends,
As rightly pointed out by many of my firends, complet stopping of cotribution is unfair labaour practices. The Management can restrict their part of contribution to the ceiling amount of Rs. 15000/-. Kindly refer the Apex court Judgement in Marathawada Gramina Bank Vs. PF authorties. It holds the decision of the Management to restrict the contribution to the ceiling limit.
The affected employees can make a representation to the Management with a copy to the PF authorities to sort out their grievances.

yes manjunath is right. we can restrict pf amount instead of stopping contribution. your company activities is aginst law.

Dear Friends ,
once a person has been enrolled as member of EPF he remains covered despite increase in ceiling limit. Discontinuance of of deduction of PF Contribution is illegal , the employer can be held liable to pay the contribution .
I agree with the opinion given bt Mr Kargaonkar, Manjunath and others.

PF Act does not restrict contribution by just mere resigning the job, whether rejoined in the same organisation OR joined in another organisation, once if employee is deducted PF, the benefit continues with irrespective of the salary drawn, so company is denying means, some one can make a confidential report to the concerned PF Enforcement Officer, they will surely take it to the beneficial of the employee.

I Had Worked With An Organization With Spanco BPO Pvt Ltd In 2011 And 2012. I Have Worked There 15 Months. I Was Unknown About The PF Bcz It Was My First Job. After 6th Month I Have Asked To Hr About My PF Number They Said They Will Provide You When You Resign From This Company. But Suddenly Company Has Been Closed Without Any Confirmation With Employee. I Have Written To Several Mail To HR Department But There Is No Any Response From That End. I Dont Have My PF Number And My Salary Was Came Via Chequa. Please Help To Get My PF Number. I Have Employee Id And Offer Later As Well.
